What an association attorney usually handles

  • Collections: late-assessment letters, liens and foreclosure of association liens.
  • Covenant and rule enforcement: violation notices, fining procedures and disputes with owners.
  • Governing documents: drafting and passing amendments to the declaration, bylaws and rules.
  • Meetings and elections: notice requirements, recalls, and records requests.
  • Contracts: reviewing management, landscaping, roofing and restoration contracts before the board signs.
  • Building safety and construction: milestone inspections, structural integrity reserve studies (SIRS) for condos, and construction-defect claims.

Florida rules that shape the hire

  • No bid requirement for lawyers. Florida's competitive-bid rules for association contracts specifically exempt attorney services, for condos (s. 718.3026(2)(a)) and for HOAs (s. 720.3055(2)(a)). Boards usually interview two or three firms anyway.
  • HOA disputes often start with mediation. Many HOA–owner disputes, such as covenant enforcement, amendments and board meetings, require a demand for presuit mediation before anyone files in court (s. 720.311).
  • Some condo disputes go to state arbitration. Certain condominium disputes go through nonbinding arbitration run by DBPR's condominium division (s. 718.1255).
  • Local court. Lawsuits in Palm Beach County are heard in Florida's Fifteenth Judicial Circuit.

Questions to ask before you hire

  • Who will actually handle our file day to day, and is anyone on the team Board Certified in Condominium and Planned Development Law?
  • How do you bill: hourly, flat fees for routine work such as collection letters and amendments, or a monthly retainer? Ask for the fee schedule in writing.
  • Do you also represent developers, or owners suing associations? How do you handle conflicts?
  • How fast do you answer board and manager questions, and is there a charge for short calls?
  • Can you give us references from associations similar to ours in size and type, whether condo or HOA, high-rise or single-family?
