Practical notes for Treasure Coast boards
- Courts. Martin County is in Florida's Nineteenth Judicial Circuit, along with St. Lucie, Indian River and Okeechobee counties. A firm that practices across the circuit can follow you if your community has properties or disputes in a neighboring county.
- Condo towers. Condo buildings three stories or taller, including the oceanfront buildings on Hutchinson Island, face Florida's milestone inspection and SIRS requirements. Ask how the firm has helped other boards plan funding and owner votes around them. Our reserve study guide explains the basics.
- No bidding required. Attorney services are exempt from Florida's association competitive-bid rules (s. 718.3026 for condos, s. 720.3055 for HOAs), so the board can choose counsel by interview.
- HOA disputes. Many HOA–owner disputes need a presuit mediation demand before a lawsuit (s. 720.311). Ask how the firm handles that step and what it usually costs.
Before you sign an engagement letter
- Get the fee arrangement in writing: hourly rates by attorney and paralegal, and any flat fees for collections or amendments.
- Ask who your main contact will be and whether that lawyer attends board meetings in person.
- Check the lawyer yourself on The Florida Bar's directory, and read what Board Certification requires.
